EMPLOYEE BAG CHECK LAW IN CALIFORNIA

Under California law, with very limited exceptions, employees are expected to be paid for all time spent under the "control of an employer." Thus, if you are subjected to mandatory bag checks (a.k.a. security searches) inside your store, the law generally considers you to be under the "control of your employer" and entitled to be paid for this time. Many employers require their workers to have their belongings inspected, whether they are arriving or leaving, and even before and after taking their breaks. Although the time spent undergoing these searches may be small, that time adds up and it deprives employees of full and uninterrupted breaks. That's unlawful.
